VelNotes Terms of Use

These Terms of Use govern access to and use of the VelNotes mobile app and velnotes.com. By using VelNotes, you agree to these terms.

1. Parties and Scope

These terms apply between VelNotes and users regarding digital notebook functions, backup/restore flows, and related web services.

2. Account, Access, and Security

Users are responsible for account accuracy and account security. Any attempt to bypass security controls or misuse access mechanisms is prohibited. VelNotes may restrict access where abuse or security risks are detected.

3. Service Scope

VelNotes provides notebook/page management, drawing/text workflows, PDF/image handling, voice recording/transcription, camera/document capture, photo-library import or export at the user's request, notebook sharing/invitation flows, optional device-local biometric lock checks, Google Drive backup, notification features, and cloud functionality depending on plan and technical availability. As part of website operations, visited-page and country/region distribution analytics may be used for product and performance improvements. In drawing workflows, an optional Finger Writing Mode may be available alongside Apple Pencil-first behavior.

4. Free and Paid Plan Rules

4.1 Free plan

Free plan supports up to 3 active notebooks you create at a time. Free users may also keep up to 3 shared notebooks in the separate Shared section. Restore flows enforce the personal 3-active-notebook cap. Firebase Firestore/Storage cloud sync and automatic cloud backup are not available on free tier. Free data remains on-device by default, with optional user-initiated manual Google Drive backup. In voice recording flows, free users can record up to 15 minutes per recording session; this duration limit does not apply to Premium/Ultra tiers.

4.2 Premium / Ultra

Premium/Ultra tiers may include expanded cloud and productivity capabilities. Notebook sharing invitations are sent from Premium/Ultra accounts; recipients may be assigned viewer/editor access and an optional duration. Concurrent active-device limits are plan-based (Premium up to 2, Ultra up to 5 active devices). Premium notebook data may be processed through Firebase cloud sync in addition to local on-device copies. Plan scope and paid features may be changed, suspended, or discontinued due to technical, legal, security, anti-abuse, third-party service continuity, or commercial requirements. Paid access grants rights for the relevant subscription period and does not guarantee that any specific feature will remain unchanged forever.

5. Billing, Subscription, and Restore Purchases

Paid subscriptions are managed through Apple App Store / StoreKit. Billing, renewal, cancellation, and refund logic follow Apple policies. Deleting an account does not cancel the subscription; users must manage or cancel subscriptions via App Store > Account > Subscriptions. Restore Purchases applies active entitlements associated with the user's Apple account. Premium rights may be temporarily unavailable if verification fails. Mandatory consumer-law rights and Apple-required refund/remedy rules remain reserved.

6. Usage Limits and Fair Use

VelNotes may enforce plan-based limits for notebooks, restores, voice recording, and cloud processing. These limits may be updated over time for product quality, security, and anti-abuse controls. Users agree to use their account in compliance with fair-use requirements.

AI/LLM-based generation features are not part of the current production scope.

7. Backup and Continuity

Google Drive backup is manual and user-triggered. Premium/Ultra cloud sync may operate as a separate cloud layer; free tier does not include Firebase cloud backup rights. Content moved to trash is retained for up to 30 days unless permanently deleted earlier by the user, then removed by automatic cleanup. When voice recording starts, audio is created in app-local recording library storage; users can delete recordings and cleanup flows may remove them. If users export a file, retention is governed by the selected destination. Voice transcription flow runs with on-device speech recognition provided by the operating system when supported; on unsupported devices this feature cannot be used. Transcription output is generated automatically on a best-effort basis and accuracy is not guaranteed; users should review results before use. In the default flow, raw voice files are not uploaded to Firestore/Storage databases. Users are responsible for taking regular backups of critical content. Uninstall, device loss, or device replacement scenarios may affect local data availability unless backups exist. Web contact/support requests are processed operationally until closure; once resolution is completed, records without an ongoing operational need may be removed.

8. User Content and Intellectual Property

Users retain ownership of notebook/page content. Users are responsible for lawful use of content they upload/create. VelNotes may process/store/transfer content as technically required to deliver the service.

9. Prohibited Conduct

Unauthorized access, reverse engineering, abuse automation, illegal content, rights violations, and service integrity attacks are prohibited.

10. Disclaimer and Limitation of Liability

Service is provided "as is" to the maximum extent permitted by law. Temporary outages can occur due to Apple, Google/Firebase, network, and external infrastructure dependencies. VelNotes does not guarantee uninterrupted or error-free operation at all times. These limitations do not remove mandatory consumer rights under applicable law.

11. Suspension and Termination

VelNotes may suspend or terminate access in case of abuse, security violations, unlawful behavior, or breach of these terms.

12. Amendments

Terms and service scope may be updated for legal, technical, security, third-party dependency, or product reasons. VelNotes reserves the right to change, suspend, or discontinue specific features (including paid features) when required. Where mandatory law requires notice or remedies, VelNotes applies those obligations. Updated terms become effective upon publication.

13. Governing Law and Contact
