VelNotes Terms of Use

These Terms of Use govern access to and use of the VelNotes mobile app and velnotes.com. By using VelNotes, you agree to these terms.

1. Parties and Scope

These terms apply between VelNotes and users regarding digital notebook functions, backup/restore flows, and related web services.

2. Access and Security

The VelNotes mobile app can be used without creating a VelNotes account. Users are responsible for keeping their device, App Store subscription under their Apple account, backup archives, and exported files secure. Any attempt to bypass security controls or misuse access mechanisms in the app, website, admin, or support infrastructure is prohibited. VelNotes may restrict access where abuse or security risks are detected.

3. Service Scope

VelNotes provides notebook/page management, drawing/text workflows, import of PDF pages as immutable backgrounds with user-added annotations and export, image handling, local audio/video file import and transcription, voice recording/transcription, camera/document capture, photo-library import or export at the user's request, optional device-local biometric lock checks, iCloud safety backup, data export, and notification features. As part of website operations, visited-page and country/region distribution analytics may be used for product and performance improvements. In drawing workflows, an optional Finger Writing Mode may be available alongside Apple Pencil-first behavior.

4. Free and Paid Plan Rules

4.1 Free plan

Free plan supports up to 3 active notebooks you create at a time. Restore flows enforce the personal 3-active-notebook cap. When iCloud Backup is enabled, a safety copy may refresh automatically after local changes or manually by the user; a restore check starts enabled by default when no active local notebook exists and can be turned off. Free data remains on-device by default, with optional user-initiated data export. Recording-library limits and some import options may vary by plan.

4.2 Pro

Pro access may be offered as weekly, monthly, or yearly subscription periods; all unlock the same in-app Pro rights. Pro tier may include expanded productivity capabilities; weekly, monthly, and yearly Pro unlock the same features, with only the billing period changing. Pro rights apply according to the active subscription or purchase state verified through Apple StoreKit. Raw voice recordings and imported media stay on device by default, while transcript text may be stored like other notebook content. Plan scope and paid features may be changed, suspended, or discontinued due to technical, legal, security, anti-abuse, third-party service continuity, or commercial requirements. Paid access grants rights for the relevant subscription period and does not guarantee that any specific feature will remain unchanged forever.

5. Billing, Subscription, and Restore Purchases

Paid subscriptions are managed through Apple App Store / StoreKit. Billing, renewal, cancellation, and refund logic follow Apple policies. Deleting the app, clearing local data, or ending support correspondence does not cancel the subscription; users must manage or cancel subscriptions via App Store > Account > Subscriptions. Restore Purchases applies active entitlements associated with the user's Apple account. Pro rights may be temporarily unavailable if Apple StoreKit verification cannot complete. Mandatory consumer-law rights and Apple-required refund/remedy rules remain reserved.

6. Usage Limits and Fair Use

VelNotes may enforce plan-based limits for notebooks, restores, voice recording, and import/transcription processing. These limits may be updated over time for product quality, security, and anti-abuse controls. Users agree to use the app and website/support channels in compliance with fair-use requirements.

External AI/LLM generation features are not offered in the current production version. Video to Text is designed to turn audio from supported local media files the user chooses into text; it does not fetch videos from YouTube or other third-party links, and it is not a general-purpose media converter. Users are responsible for importing audio/video files only where they have the necessary rights or permission.

7. Backup and Continuity

When enabled, iCloud Backup is a separate user-controlled safety layer that may refresh automatically or manually; the default-on restore check may bring back the latest backup when no active local notebook exists. Data export is manual and user-triggered. Each move to Trash writes a new deletion timestamp; restore clears it, and re-delete restarts the 30-day period. Expired content is removed locally on the first eligible app maintenance run and from the iCloud archive when it is read or refreshed. When voice recording starts, audio is created in app-local recording library storage; users can delete recordings and cleanup flows may remove them. If users export a file, retention is governed by the selected destination. Audio/video transcription uses on-device speech recognition provided by the operating system when supported; on unsupported devices this feature cannot be used. Video to Text works only with supported local media files and within the in-app duration limit. Transcription output is generated automatically and may contain mistakes; users should review results before use. In the default flow, raw audio/video files are not uploaded to VelNotes servers as notebook content. Users are responsible for taking regular backups of critical content and reviewing their iCloud backup and exported archives regularly. Uninstall, device loss, or device replacement scenarios may affect local data availability unless backups exist. Support emails sent by the user are processed until resolution; once the response and legal-retention need ends, mailbox records may enter deletion flows.

8. User Content and Intellectual Property

Users retain ownership of notebook/page content. Users are responsible for lawful use of content they upload/create. VelNotes may process and store content locally, create iCloud backup archives, and export data as technically required for the app features you choose.

9. Prohibited Conduct

Unauthorized access, reverse engineering, abuse automation, illegal content, rights violations, and service integrity attacks are prohibited.

10. Disclaimer and Limitation of Liability

Service is provided "as is" to the maximum extent permitted by law. Temporary outages can occur due to Apple system services, iCloud/Files access, App Store infrastructure, network conditions, and similar third-party dependencies. VelNotes does not guarantee uninterrupted or error-free operation at all times. These limitations do not remove mandatory consumer rights under applicable law.

11. Suspension and Termination

VelNotes may suspend or terminate access in case of abuse, security violations, unlawful behavior, or breach of these terms.

12. Amendments

Terms and service scope may be updated for legal, technical, security, third-party dependency, or product reasons. VelNotes reserves the right to change, suspend, or discontinue specific features (including paid features) when required. Where mandatory law requires notice or remedies, VelNotes applies those obligations. Updated terms become effective upon publication.

13. Governing Law and Contact
